Terms & Conditions.
How our assessments, digital services, and websites may be accessed and used.
01Overview and acceptance
These Terms & Conditions (“Terms”) describe the rules for using the websites, assessments, digital products, and related services offered by The Career Brand, LLC (“The Career Brand,” “we,” or “us”), including the Emotional Intelligence Index (“EII”) and, once released, the Career Brand 360 experience (collectively, the “Services”).
By accessing or using the Services, you agree to these Terms and the Privacy Policy. If you use the Services for an organization, you represent that you are authorized to act on its behalf where relevant. Additional purchase or organization agreements may apply.
02Who may use the Services
Users must be legally able to enter an agreement and must satisfy any age, invitation, or organizational eligibility requirements displayed during registration. Access may be limited to invited participants or accounts supplied through an organization.
Review needed before publication
03Accounts and security
You agree to provide accurate registration details, safeguard your credentials and verification codes, and notify us promptly if you suspect unauthorized access. You are responsible for activity performed through your account except where applicable law provides otherwise.
We may employ identity or access verification, including one-time passcodes, to help protect accounts.
04Assessments and feedback
The EII and Career Brand 360 are designed for learning, self-reflection, leadership development, and related professional-development activities. Assessment questions, responses, visualizations, and reports are educational tools, not medical or mental-health diagnoses, and do not guarantee employment, promotion, or other outcomes.
Career Brand 360 may involve self-assessments and input from invited peers, managers, colleagues, or other reviewers. Participants must submit feedback that is lawful, relevant, and respectful, and must not misuse invitations to collect information about others without appropriate permission.
Where an organization purchases or administers an assessment, visibility of results, responses, and reports is governed by the relevant product settings, participation notices, and applicable agreements.
Review needed before publication
05Permitted use and restrictions
We grant you a limited, revocable, non-transferable permission to access the Services for their intended purpose, subject to applicable purchases or subscriptions. You may not resell, copy, scrape, reverse engineer, redistribute, misrepresent, or interfere with our systems or assessment content, except as allowed by law or written agreement.
You may not upload unlawful material, infringe others’ rights, compromise account security, or use feedback features for harassment, discrimination, or retaliation.
06Intellectual property
The Career Brand and its licensors retain rights to the Services, assessment frameworks, questions, visual identity, trademarks, software, and original content. Your responses remain subject to the applicable rights and permissions described in the Privacy Policy and any organization agreement.
Unless another agreement says otherwise, you may use reports made available to you for your own professional development but may not publish or commercialize the underlying assessment materials.
07Purchases, subscriptions, and refunds
Some Services may require a one-time payment, subscription, or organization license. Applicable pricing, billing frequency, taxes, cancellation instructions, and refund terms should be presented at purchase or in a separate agreement before payment is accepted. Mobile purchases may also be subject to Apple or Google billing policies when used.

08Organizations and administrators
Organization account holders are responsible for providing appropriate participant notices, managing authorized administrators, and using results consistently with applicable laws and agreements. They must not use assessment content or feedback in a manner that violates privacy, employment, or anti-discrimination requirements.
If there is a separate contract between The Career Brand and an organization, that contract may govern organization-specific obligations and conflict resolution.
09Service changes and availability
We may improve, update, suspend, or discontinue features, including features described as “Coming Soon.” Screenshots, demonstrations, and previews may change before release. We do not guarantee uninterrupted availability, but will take reasonable steps appropriate to the Services and applicable commitments.
10Third-party services
Links or features may connect you to independent services, including app stores, payment processors, hosting services, or login and messaging providers. Those providers may have their own terms and privacy notices. We are not responsible for independent third-party content or practices beyond our legal obligations.
11Disclaimers and liability
To the extent allowed by applicable law, the Services are provided without warranties beyond those expressly stated in a separate written agreement or required by law. Assessment insights reflect inputs and methodologies and should be interpreted in context.
Any limitation of liability or exclusion of damages must be interpreted subject to applicable consumer and other laws. Nothing in these Terms limits rights or remedies that cannot legally be excluded.

12Termination and changes to Terms
You may stop using the Services at any time, subject to any remaining billing obligations under a purchase agreement. We may restrict accounts for material Terms violations, suspected fraud, security threats, or as required by law, with notice when appropriate.
We may update these Terms from time to time. We will indicate the revised effective date and provide any additional notice required by law or a governing agreement.
